General Terms and Conditions

Unless expressly agreed otherwise, these "General Terms and Conditions" (in short: T&C) apply to all legal transactions and contractual relationships concluded between Schischule Koch Brunnhofer GmbH and its customers as contractual partners.

The object of Schischule Koch Brunnhofer GmbH is the operation of a snow sports school in the sense of a ski and snowboard school.

This therefore includes the services of providing instruction in the skills and knowledge of snow sports, in particular skiing and snowboarding (but without any guarantee of specific training success), as well as guiding and accompanying snow sports, in particular skiing and snowboarding.

Multiple teacher changes are possible due to the flexible organisation. Private and group courses take place in all weathers.
Lift tickets are not included in the course price. All costs for the use of all lifts shall be borne by the course participant as the contractual partner.

However, children up to the age of 5.99 years are provided with so-called "children's lift passes" for ski school lessons by Schischule Koch Brunnhofer GmbH.

Outside of ski school lessons, children up to the age of 5.99 do not need their own lift pass in the Obertauern ski resort and ski for free.

Reservations for private and group courses may be made in person on site, at the partner hotels, via the internet or by phone.

The offers of Schischule Koch Brunnhofer GmbH are subject to change (non-binding).

Only the written order confirmations of Schischule Koch Brunnhofer GmbH are authoritative for the acceptance of the reservation and the scope of the service. Verbal or telephone agreements are only valid if expressly confirmed in writing by Schischule Koch Brunnhofer GmbH.

For bookings made on site (private and group courses), a contractual relationship is only established when the necessary course card is purchased or issued.

The same applies to bookings made using remote means of communication, whereby the necessary course card must be collected by the customer from the ski school office before the start of the service provision.

In all cases, the course card will only be issued once the course fees have been paid in full before the start of the course.

All prices quoted by Schischule Koch Brunnhofer GmbH are in EURO and, unless otherwise agreed, include statutory VAT. Information in price lists is provided without guarantee. No liability is accepted for any printing errors.

If no other written agreements have been made, a deposit of at least 50% of the invoice amount must be paid immediately after receipt of the written order confirmation for contracts concluded via the internet or other means of distance communication and which relate to private and group courses.

This deposit must be credited to the account of Schischule Koch Brunnhofer GmbH three working days before the start of the service provision. The remaining amount must be paid before the start of the service provision.

If expressly agreed in writing with Schischule Koch Brunnhofer GmbH in individual cases, the total amount of the course costs may also be paid in cash directly to the ski instructor or to a person authorised by Schischule Koch Brunnhofer GmbH to receive the course fee immediately before the start of the service.

For contracts to be concluded at the place of fulfilment, the fee for the service to be provided must be paid in cash or using standard electronic means of payment at the office of Schischule Koch Brunnhofer GmbH before the start of the course.

In the event of late payment, Schischule Koch Brunnhofer GmbH is entitled to demand statutory interest on arrears from the contractual partner.

Credit card payments in favour of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain in which you enter and process your payment is owned and operated by TREKKSOFT. Please send an email to support(at)payyo.ch for all enquiries about your credit card payments and chargebacks.

Der Vertragspartner erteilt durch die Annahme der AGB’s der Schischule Koch Brunnhofer GmbH seine ausdrückliche Einwilligung und Zustimmung, dass im Rahmen des erteilten Skiunterrichts und den damit verbundenen Veranstaltungen seitens der Schischule Koch Brunnhofer GmbH Lichtbilder angefertigt werden und auf deren Website, der Facebook-Seite und auf sonstigen Socialmedia-Seiten, insbesondere Instagram, veröffentlicht werden können. Seitens des Vertragspartners können hieraus keine wie immer gearteten Rechte abgeleitet werden, sodass mit Annahme der AGB’s der Schischule Koch Brunnhofer GmbH hierauf ausdrücklich verzichtet wird.

Der Vertragspartner kann die Einwilligung und Zustimmung zur Veröffentlichung ihn oder sein Kind nachweislich zeigender Lichtbilder auf der Website, der Facebook-Seite, oder auf sonstigen Socialmedia-Seiten der Schischule Koch Brunnhofer GmbH im Vorhinein gegenüber dem Autor mündlich oder schriftlich verweigern bzw. im Nachhinein schriftlich unter Angabe des konkreten Lichtbildes jederzeit widerrufen.

Erfüllungsort ist der Ort der zentralen Niederlassung der Schischule Koch Brunnhofer GmbH (Schischule Koch Obertauern). 

Für sämtliche Rechtsstreitigkeiten aus dem Vertragsverhältnis ist das am Sitz der zentralen Niederlassung der Schischule Koch Obertauern GmbH örtlich und sachlich in Betracht kommende Gericht zuständig.

Es gilt österreichisches Recht als vereinbart. Die Vertragssprache ist Deutsch.

Sollten einzelne Bestimmungen dieser Allgemeinen Geschäftsbedingungen unwirksam sein oder werden, so berührt dies nicht die Wirksamkeit der übrigen Bestimmungen sowie des gesamten Rechtsgeschäftes. Die unwirksame Bestimmung ist durch eine solche zu ersetzten, die der unwirksamen Bestimmung wirtschaftlich am nächstem kommt.

Änderungen dieser Allgemeinen Geschäftsbedingungen bedürfen der Schriftform.
